Fitness Australia has announced that its mediated negotiation with Phonographic Performance Company of Australia (PPCA) has failed.

In a statement on discussions held yesterday on Tariff V, Fitness Australia Chief Executive Lauretta Stace, said "Fitness Australia entered into a mediated negotiation with the PPCA but unfortunately didnât get close to what the fitness industry would consider a commercially viable rate for Tariff V."

Fitness Australia will now proceed with the Appeal of the Copyright Tribunal decision in the Federal Court and this is scheduled to take place on 26th November 2010.

Fitness Australia will also continue negotiations with the Australian Performing Rights Association with respect to the Copyright Tribunal decision in the PPCA matter.

On 17th May 2010, the Copyright Tribunal decided to allow the Phonographic Performance Company of Australia (PPCA)'s application to significantly increase the fee for music in fitness classes. The decision related to PPCA's Tariff V which has now increased to $15 per class or $1 per attendee per class - an increase of over 1,500% for the cost of this licence to businesses in the fitness industry.
