read moreNSW Fair Trading Minister Stuart Ayres has said it is totally unacceptable for event promoters to leave ticket holders high and dry by cancelling a New Year's Eve festival due to be held at the Wet'n'Wild Sydney attraction.
The Minister said New Year's Eve was a great night of entertainment for many but tonight thousands of revellers had been let down by event organisers One Cube Entertainment.
Advising that a NSW Department of Fair Trading case manager had been appointed to deal with complaints and enquiries, Minister Ayers stated "we want to ensure consumers are dealt with according to Australian Consumer Law (ACL) provisions.
"These provisions require consumers to receive a full refund when services are not provided, if they so choose.
"We understand the promoters are planning to re-stage the event on Australia Day.
"We expect them to provide full refunds to patrons who want one.
"The ACL provides for consumers to receive compensation for consequential loss, where services aren't delivered."
Minister Ayres said consumers had every right to be disappointed by the late cancellation, adding "the promoter's website refers to a major technical production issue causing the cancellation.
"The promoters appear to be offering the same line-up at another venue, The Roxy, from 6pm tonight or for patrons to use their ticket for another event at Wet'n'Wild (Sydney) on Australia Day."
Wet'n'Wild Sydney has sought to distance itself from the debacle, saying the venue was hired by an external promoter.
